Terms and Conditions
These terms set out the basis on which Al Waseet Support provides its services. Please read them carefully before you instruct us. By asking us to start work you agree to be bound by them.
1About us
- 1.1Al Waseet Support ("we", "us", "our") is the trading name of Alwaseet Support Ltd, a private limited company registered in England and Wales.
- 1.2Our correspondence address is 4th Floor, 45 Fitzroy Square, London, England, W1T 6ED. You can contact us by email at info@alwaseetsupport.com or by telephone on 07888 868680.
- 1.3"You" means the person or organisation that instructs us. "Services" means the work we agree to carry out for you. "Provider" means any third party, such as a university, college, translator, agent, insurer or adviser, that we introduce you to or deal with on your behalf.
2Our services
- 2.1We provide educational support, admissions and application support, consultation, administrative and form-filling support, follow-up with companies and organisations, property-search support, translation and interpreting, and community support.
- 2.2Our role is that of an administrative support provider and intermediary. We prepare, submit and follow up paperwork on your instructions, and we introduce you to suitable Providers.
- 2.3The exact Services, the expected timescale and the fee will be confirmed to you in writing (including by email or message) before we begin.
3Services we do not provide
- 3.1We are not a firm of solicitors and we do not provide legal advice or conduct litigation.
- 3.2We do not provide immigration advice or immigration services.
- 3.3We are not authorised by the Financial Conduct Authority. We do not provide financial, investment, insurance, mortgage or debt advice, and we do not carry on claims management activity. Our help with claims is limited to completing forms on your instructions and requesting updates on your behalf.
- 3.4We are not an estate agent or letting agent. We do not market property, negotiate sales or tenancies, or hold deposits or rent. Any sale or letting is carried out by the licensed agent we introduce you to.
- 3.5Where your matter requires a regulated professional, we will tell you and, if you wish, introduce you to one. Nothing we say should be relied on as advice of a kind listed in this section.
4Forming a contract with us
- 4.1A contract between us is formed when we confirm in writing that we accept your instructions.
- 4.2We may decline any instruction at our discretion, including where we cannot verify your identity or where we believe the instruction to be unlawful or dishonest.
- 4.3If you ask us to change the Services after we have started, we will tell you about any effect on the fee or timescale before proceeding.
5Fees and payment
- 5.1We will tell you our fee, or how it will be calculated, before any work starts. We will not begin until you have agreed to it.
- 5.2We will tell you whether VAT applies to our fee. Unless we say otherwise, payment is due on receipt of our invoice.
- 5.3Fees charged by Providers or public bodies, such as application fees, translation certification fees, agent fees and government fees, are not included in our fee. You are responsible for them and you pay them directly to the Provider or body concerned.
- 5.4We issue an invoice or receipt for every payment we receive.
- 5.5If an invoice is not paid when due we may suspend the Services until payment is received.
6Client money
- 6.1We do not hold client money. We do not receive, hold or pass on deposits, rent, purchase funds, compensation, tuition fees or any other money on your behalf.
- 6.2Any compensation, refund or other payment due to you is paid to you directly by the organisation concerned.
- 6.3We accept payment of our own fees only from you or from a person you have identified to us in advance.
7Identity checks and prevention of fraud
- 7.1We may ask you for proof of your identity and address before or during the Services, and we may keep copies for our records.
- 7.2We will not prepare, submit or support any application, claim or document that we know or suspect to be false, misleading or forged. If we form that suspicion we will stop work immediately.
- 7.3We may report suspected fraud or other criminal activity to the relevant authorities without notice to you where the law permits or requires it.
8Your responsibilities
- 8.1You must give us complete, accurate and truthful information and documents, and tell us promptly if anything changes.
- 8.2You must respond to our requests in good time. Deadlines set by universities, colleges, insurers and other organisations are outside our control.
- 8.3You must check everything we prepare before it is submitted in your name. You remain responsible for the content of any application, form or statement you approve.
- 8.4You confirm that you are entitled to give us any personal information you provide about other people, such as family members.
9No guarantee of outcome
- 9.1Decisions on admissions, funding, claims, complaints, tenancies, sales and similar matters are made by the relevant organisation and not by us.
- 9.2We will carry out the Services with reasonable care and skill, but we do not guarantee any offer, place, payment, property, decision or timescale.
10Providers and commission
- 10.1When we introduce you to a Provider, your contract for that Provider's service is with the Provider and is governed by the Provider's own terms. We are not a party to it.
- 10.2We are not responsible for the acts, omissions, charges or insolvency of any Provider.
- 10.3We may receive a fee or commission from a Provider we introduce you to. We will tell you whether we do, and the amount or basis, if you ask.
11Your right to cancel
- 11.1If you are a consumer and our contract was made at a distance (for example online, by telephone or by email) or away from business premises, you have the right to cancel within 14 days of the contract being formed, without giving a reason.
- 11.2To cancel, tell us clearly by email at info@alwaseetsupport.com or by telephone before the 14 days end.
- 11.3If you ask us to begin the Services during the cancellation period and then cancel, you must pay for the Services provided up to the time you tell us. If the Services have been fully performed at your request within that period, the right to cancel is lost.
- 11.4Refunds due on cancellation are made within 14 days of your notice, using the payment method you used.
12Ending the contract
- 12.1You may end the contract at any time by giving us written notice. You will pay for work carried out up to that point.
- 12.2We may end the contract by written notice if you do not pay sums due, do not provide information we need, provide false information, or behave abusively towards our staff or Providers.
- 12.3On ending the contract we will return original documents belonging to you on request.
13Confidentiality and data protection
- 13.1We keep your information confidential and use it only to provide the Services, to meet our legal obligations and to keep our records.
- 13.2We process personal data in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018. Our Privacy Notice explains what we collect, why, who we share it with and your rights.
14Our liability to you
- 14.1Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Your statutory rights as a consumer are not affected.
- 14.2Subject to that, we are not liable for decisions, delays, errors or omissions of any Provider or other third party; for loss arising from inaccurate, incomplete or late information supplied by you; or for loss that was not a foreseeable result of our breach.
- 14.3Subject to the first clause of this section, our total liability to you in connection with any Services is limited to the fees you paid us for those Services.
- 14.4We provide the Services for your private or internal business use. We are not liable for loss of profit, loss of business or loss of opportunity.
15Complaints
- 15.1If you are unhappy with any part of our service, please tell us by email at info@alwaseetsupport.com so that we can put it right.
- 15.2We acknowledge complaints within 5 working days and aim to give a full written response within 28 days. Our Complaints Procedure sets out the steps.
16Events outside our control
- 16.1We are not in breach of these terms, or liable for delay, where it is caused by an event outside our reasonable control, including failure of third-party systems, postal or network disruption, or the actions of any authority or Provider.
17Use of this website
- 17.1The content of this website is for general information only and is not advice. We may change it at any time.
- 17.2The website, its text, design and logo belong to us. You may not copy or reuse them for commercial purposes without our written consent.
18General
- 18.1We may update these terms from time to time. The version published on this website on the day we accept your instructions applies to those instructions.
- 18.2If any part of these terms is found to be unenforceable, the remainder continues in effect.
- 18.3No one other than you and us has any right to enforce these terms.
- 18.4You may not transfer your rights under the contract without our consent. We may transfer ours to a successor business, and we will tell you if we do.
- 18.5A delay by us in enforcing a right does not waive it.
19Governing law and jurisdiction
- 19.1These terms and any dispute arising from them are governed by the law of England and Wales.
- 19.2The courts of England and Wales have jurisdiction, except that a consumer resident in Scotland or Northern Ireland may also bring proceedings in the courts there.
